Top Reasons That Made English a Dominant Language

If you can speak English, you will probably be able to communicate with someone in just about any major country you could visit. While not everyone speaks this language, English is truly a dominant language spoken by millions across the globe. Experts state that around a third of the world's population speaks English as their native language, and many more study it as a second language. What caused English to spread beyond the bounds of the British Isles and become such an important player in global communication? The answer begins with a look at the language's original speakers, the English.

English Dominance in the 19th Century

In the 19th century the British Empire was truly a global empire. As some said at the time, "the sun never sets on the British Empire." Great Britain held colonies on every continent, and the trade language in those areas was English. By the end of the 19th century, the British Empire's reach was global, and the language was also becoming global. This influence continued into the 1900s, and by 1922 the British Empire had an influence over around 458 million people, close to a quarter of the world population of the time, which meant that knowing English was important.

The Rise of America as a Global Power

Even though it is a relatively young country in light of world history, the United States has become a global superpower, specifically after World War II. America has a hand in politics, economics, and culture around the world. As such, English is becoming more and more important as a global language. When you add the influence of America in today's global economy to the historic and current influence of Great Britain, understanding English becomes almost essential to carrying out business in the current economic market.

English Is the Language of Technology and Science

As you browse the World Wide Web, you will find that most websites are in English or have an English translation available. This shows how influential English is in the world of technology. Since many of the technological devices created across the globe are marketed heavily in America, they are designed with English-speaking users in mind. You can see this in the design of the computer keyboard. Most standard keyboards contain the standard letters of the English alphabet, which is further proof that English is the language of technology.

In addition, English is the language of science. The Science Citation Index reports that over 95 percent of all of its documents are English documents, even though a majority of them are writing by non-native English speakers. The medical community also uses English as a unifying language, making it essential for doctors to learn if they wish to be able to read reports and journals about the latest medical breakthroughs.

English is the Language of International Organizations

When multiple countries come together, they must choose a language to speak. Often the language chosen is English. The official language of the United Nations, for instance, is English. The same is true for the International Olympic Committee. At the Olympics, announcements are made in the language of the host country and in English. English is also one of the official languages of the European Union.

Other Uses of English Cause It to Have Global Impact

English is the international language of many industries, including banking, computing, business, diplomacy, and even entertainment. An international treaty aimed at making communication easier made English the official language of aviation and maritime activities.

The list of industries or functions where English is one of the main languages spoken is truly never ending. The simple fact is that since the late 1800s, English has been spoken in more locations across the globe than any other language, and that fact, coupled with the economic and political power of the United States and Great Britain, means that English will continue to have massive impact on the global economy in the future.

Fundamentals of Contract Law

No matter where you live in North America, you must have seen some humoristic vignettes depicting a not-so-trustworthy Realtor intent at selling a house to some innocent-looking couple. My favorite vignette, which still makes me chuckle today, goes back to a few years ago when I was practicing real estate at United Realty. It involved a Real Estate Agent of Pompeii Realty, briefcase in hand, in the process of selling a house to an ancient Roman couple sometimes around 100 BC . The house is overlooking Mt. Vesuvius. There is a black, threatening, ominous plume of smoke coming out of the top of the volcano, and the Roman couple looks somewhat startled when the Real Estate Agent - big smile on his face - delivers the punchline: " Plus, with a view like this what could possibly go wrong" !

What is it exactly that you do when you sign a 'contract' . The term 'contract' means a promise or a set of promises made by one person to another, which the Courts will enforce. A contract can contain a number of promises or 'terms' to be performed by either party. The person who makes the promise is called the 'promissor' and the person who can enforce that promise is called the 'promissee' . If the contract contains several mutual promises, each party will be both a promissor and a promissee. Contracts of Purchase and Sale of land and interests in land usually have lots of mutual promises. Contracts are a crucial part of every business transaction, but not nearly as much as in Real Estate. For instance, some contracts are made verbally while others are made by simply exchanging letters or even e-mails. This is not the case in Real Estate, where it is a requirement at Law that contracts be written down in usually lengthy legal forms to avoid uncertainty, ambiguity and to be binding .

A contract has seven essential elements:

Fundamentals of Contract Law

Offer.

Acceptance.

Consideration

Legal Intent.

Capacity.

Legal Object.

Genuine Consent.

Each of these elements must be present for a contract to be binding and enforceable. Let's examine them individually.

OFFER

An offer is the promise made by one party to another. Save and except in Real Estate where the offer must be in writing, an offer can be made in any form. In all circumstances, however, an offer must be made in clear an unambigous terms. If more than one interpretation can be given to an offer, neither interpretation will be followed by the Courts. There are 'unilateral' and 'bilateral' offers. Offers to purchase real property are bilateral, i.e. containing the exchange of mutual promises.

An offer is not made forever. Offers can either be finalized, when all mutual promises are fulfilled. Or they can expire, if not timely accepted. Or they can be released, if one of the parties does not - or cannot - deliver on the promise. Offers can also be revoked after acceptance, unless a term of the offer stipulates that revocation is not allowed.- as it is now the case in British Columbia for offers involving land. A 'counter-offer' is simply an offer from the offeree back to the offeror. The legal effect of a counter-offer is to terminate the original offer and substitute the offer of the offeree. What this means in practicality is that if the counter-offer is not accepted, the offeree cannot try to accept the first offer unless it is tendered again by the offeror. This is a point often times neglected in Real Estate, which has caused several tears to be spilled.

ACCEPTANCE

The acceptance, like the offer, must be given in clear terms. It must be a positive act. For instance, an offer cannot state "If I don't hear from you, I will assume you have accepted". Doing nothing will never be considered legal acceptance. The rule at Law is that where an offer is required by statute to be in writing, then also the acceptance must be in writing in order for the offer to become a contract binding on both parties. Such is the case in Real Estate. An acceptance has no effect until it is communicated to the offeror. Communication can be made by 'instantaneous means' as in the case of telephone or teletype or fax communications, or e-mail or hand-delivery and by 'non-instantaneous means' such as postal mail. The Law gives the responsibility to the offeror to specify how he wants the offer to be accepted. If the offeror chooses a method like slow mail, then he assumes the risks involved in that type of service (such as misdelivery).

CONSIDERATION

For an offer and acceptance to form a contract there must be consideration or the contract must be signed under seal. Consideration is defined as 'some right, benefit or profit accruing to the promissor or some forebearance, detriment, loss or otherwise responsibility suffered by the promissee' . What this means is that the party trying to enforce the contract must have 'paid' something in exchange for the promise of the other party. Consideration must be of real value, but it does not have to be money. For example, a mutual exchange of promises is consideration per se.

LEGAL INTENTION

For a person to be bound to a contract, he must seriously intend to create legal obligations. For example, inviting a guest for dinner would normally not be considered a contract intended to create legal obligations. The Law presumes that there is legal intention in a contract involving total strangers. On the other hand, if the contract is between family members the Law presumes that there is no intention to be so bound (non arm-length transaction). However, this presumption can be reversed if there is evidence to show otherwise.

CAPACITY

Even when all the foregoing essential elements exist, a contract can still be void, voidable or illegal. A void contract is one which is deemed at Law never to have existed. A voidable contract is slightly different: it exists until it is repudiated by one of the parties. An illegal contract is one which is made for an illegal purpose, and which is therefore always void. Examples of voidable contracts are the ones made when one of the parties is an infant, i.e. a minor or under the majority age. In this case the contract can be voided by the infant. Likewise, when one of the parties is legally insane, the contract is voidable. A special case is a contract stipulated when one of the parties is a limited company or corporation. Three questions must be first answered before the contract can be enforceable: 1) whether the corporation does in fact exist and 2) whether it has the capacity to enter into the contract and 3) whether the person signing on behalf of the corporation is, in fact, the authorized signatory.

LEGAL OBJECT

Quite aside from blatantly illegal contracts such as, for examples, contracts to commit a crime or tort until recently here in British Columbia certain other types of contracts where considered illegal. For example, until the mid-80's contracts involving the sale of land made on a Sunday were deemed to be a contravention of s.4 of the Lord's Day Act(now repealed) and, thus, illegal and void. Since then, the Supreme Court of Canada has ruled that the application of s.4 - in fact the entire Lord's Day Act - is unconstitutional in that it infringes on the freedom of conscience and religion guaranteed by the Canadian Charter of Rights and Freedom.

GENUINE CONSENT

If one of the parties makes a misrepresentation or if the contract contains an inherent mistake, the contract may still not be binding. A misrepresentation is, by definition, a statement which is false and which must have induced one of the parties to enter into the contract. A misrepresentation can be innocent, negligent or fraudulent and different remedies are available to the party suffering damages because of the nature of the misrepresentation. If the representation is innocent, the party can sue for rescission of the contract. In the case of negligent or fraudulent misrepresentation, the affected party can sue for damages as well. Although misrepresentation requires a statement to be made, in Real Estate silence too can result in some form of misrepresentation. Disclosure of latent defects is one such example: failure to disclose latent defects on the part of the Seller will not, by itself, affect the consent of the parties but will have similar consequences as misrepresentation.

In the case of inherent mistake, true consent of the parties does not exist. The logic behind this notion is that the parties were negotiating for a subject matter other than the one stipulated in the contract. A specific type of mistake is sometimes referred to as 'non est factum' , Latin for 'this is not my deed' . This occurs when a person executes one form of document thinking the document is something else. Duress and undue influence both affect the genuine consent element of a contract. Duress occurs when a person is forced to enter into the contract against his will. As a result, the Courts will find the contract voidable at his option. Undue influence, on the other hand, is more subtle. Like duress it results in one party losing his free will to contract out. However it occurs more frequently when a person is in a superior or dominant position in relation to another and uses this influential position to induce the other to enter into the contract. Again, if undue influence is found, the contract is voidable at the option of the innocent party.

The Economic Situation of the Construction Industry

The construction industry is very important to the UK's - and indeed to the world's - economy. In the UK, it accounts for more than 10% of the country's gross domestic product and employs an estimated 2.5 million people. In the last three years, an extra £33 billion has been made available to this sector to increase public services. Included in this figure are major investments in transport, health and housing. As the industry is investment-driven, it is subject to the strictures of economic upturns and downturns; during the recessions of the mid 1980's and the early 1990's, there were significant downturns. However, in the late 1990's, there was a marked swing in the opposite direction.

Our construction industry, by very nature of its geographical location, is not subject to the full influences of cross-border competition that are in evidence in mainland Europe. However, construction industries worldwide have been affected by the current economic climate and the increasing rise in fuel prices. For the earlier part of 2008, the German construction industry showed a marked upturn, but this slowed and tailed off later in the year, due to the increase in oil prices and the slowing economic pace of many industrialized countries. In addition to economic factors, there is a turn in the tide of ecological factors. In America, the number of people citing Global Warming as the most important environmental issue rose from 11% in 2003 to 35% in 2006. The construction industry faces new challenges in replacing and renovating buildings with minimal environmental impact. At the same time, the cost of these precautions has to be measured against potential profits.

However, despite the factors that seem to be conspiring against it, the construction industry moves at a very fast pace and is an ever-changing entity. Whilst legislation is forever altering, new techniques, technology and methods are developing to keep up. With the development of new practices, new jobs in construction are perpetually being created. In the UK, the Home Office has released figures stating that the three construction jobs that are most lacking in applicants are those for transportation and highways engineering, ground engineering and contaminated land specialists. With major infrastructures and building developments taking place in the South East of the UK, such as the 2012 Olympics and the Thames Gateway regeneration, construction recruitment in this area is set to soar. Britain's Olympic Games will have 30 venues and a budget of £2.3 billion. It also has a non-negotiable, absolute completion date. As that date draws nearer, the construction industry will find itself heavily in demand as pressure and expectation rise. 2012 promises to be an important year for this industry and many are looking upon it as a chance to showcase its talents.

Of course, construction takes place across the globe and this gives workers a chance to travel as well as work. Construction jobs require large teams of people all working to a common goal and, while the lifestyle can be quite temporary, many get used to it and find it a liberating existence. Some projects are short-term, whilst others can last for years - such as the construction of an oil refinery.

There are many who believe the fiction that it costs too much to buy and prepare nutritious food. The truth is that eating healthy on a budget is very possible if you shop wisely. Heart healthy food is necessary to prevent child obesity.

The legend was put to the test not long ago by a reporter for the Los Angeles Times. It was proven at the check register that it is just a little cheaper to purchase healthy choices.

There are a lot of popular brands that promote their product as "heart healthy food" and charge a little more. You can, however, still find similar products to help you meet your goals to prevent child obesity in your family and save money at the check stand.

Shopping for Heart Healthy Food on a Budget

Here are some smart ideas to help economize while eating healthy on a budget in this tough economy.

1. Compare similar products using price and the Nutrition Facts Label. Some name brands products offer the same nutritional benefits as the ones which are store brands.

2. Check the price tag and the Nutrition Facts Label on the back of each product. Then choose the one with the highest nutritional content and lower cost. It's very important to prepare heart healthy food in order to prevent child obesity.

3. Check the price of each unit and buy healthy food items in larger quantities. Oftentimes buying items in larger quantities will save you money. You should only do this with food products that you use a lot. Be careful not to over buy.

4. Take advantage of in-season produce. Fruits and vegetables that are in-season often cost less. You can find organic produce at the farmer's market which shouldn't be any more expensive than what you find at the grocery store.

Oftentimes these products will be fresher and more nutritious. Keeping fresh fruits and vegetables on hand will help you to encourage your family to eat healthy snacks. Eating fresh fruits and vegetables will help your family prevent child obesity.

5. Check to be sure the fruits and vegetables are in good condition. Small cuts on the fruits or even bruises caused by improper handling will promote spoilage. Inspect every fruit and vegetable piece before you buy so that you won't waste money by having to discard food that spoils prematurely.

A healthy diet is a must in preventing childhood obesity in your home. You can keep you family eating healthy on a budget if you properly prepare before going shopping. Having a shopping list and being selective in your choices are the important things that you have to remember in order to economize on heart healthy food and prevent child obesity in your family.

Trading Opportunity - Dollar to Remain Firm on the Euro

There have been many traders who have bought the euro against the dollar but we think there optimism is misplaced and the euro will move lower and we haven't changed our view and see further weakness for the following reasons...

The expansion of the US quantitative easing program and the start of the expansion of the money supply in March saw investors start to sell what had been seen as a "safe haven" currency 0 but the dollar is in not going to collapse just yet for the following reasons.

The world is still in a recession and there will, be a few more months of bad economic reports to see safe haven flows move into the dollar. The recent strength in stock markets looks like short covering and the big trend is down. Investors have made a lot out of the Fed printing money - but so to are all other major economies so this is not a factor in the short term.

Trading Opportunity - Dollar to Remain Firm on the Euro

A cheaper US$ is inevitable to restore the global imbalances reflected in America's huge current account deficit but this will not become a factor until we see an improvement in the global economy and were not there just yet. While the one way traffic of dollar buying maybe over, the dollar will remain firm in the short term.

We expect other currencies to vary in their fortunes against the dollar; we see further room for euro weakness and think it looks overvalued for the following reasons.

Euro Interest Rates took it up now there Taking it Down

We have been euro bears for months and we are being rewarded for our view long ago when it was up at 1.60, we said it would probably target 1.20 and it is and the reason for this was, the whole rally of the euro from the par level, was simply based upon interest perceptions that the ECB would hold or raise rates.

While the ECB continues to talk tough on interest rates, citing concerns of a liquidity trap whereby rates are so low that growth will be unresponsive to additional easing but this is not the real problem the real problem relates to the Euros value in international purchasing terms. The ECB is the odd central bank out in its stance on interest rates as it continues to resist aggressive cutting. the more it continues to hold off the inevitable the more the euro zone economy gets hurt and its getting hurt right now.

Europe is deep in recession and the outlook is not pretty -first quarter GDP decline set to far bigger than the sizable Q4 economic contraction. The latest industrial production data points to a faster deterioration than in the UK and weak consumer confidence is reflected in declining retail sales.

The strong euro threatens to make is widening the current account deficit. The fiscal stimulus package looks weak compared with the US one. The inevitable result of all the above is - The euros yield advantage will be wiped out and the euro will fall.

1.40 Looks about the best we will see on the upside and we see a move back down below 1.35 and probably below 1.30 in the coming weeks and maybe even a move back to 1.25.

We have been short this big trend since 1.59, as regular readers of our reports know and it's a big trend and its not over yet; expect more weakness and more profits. Continue to sell the rallies on falling momentum and hold shorts.

Retail Economics

All the drama going on in the world economy has thrown a whole heap of debate of what will happen next. Some of the dialogue has been confusing. Politicians and the media have not made it any easier with their fear campaigns, spin or just general lack of understanding of economic fundamentals.

I am here to give you an understanding of what has happened, and how all of this massive change will affect consumer spending - you know the people who shop in your stores.

Debt Levels got out of Hand in the US - Let's not too caught up in this sub prime thing. Basically debt is debt, and Americans have a lot of it. And don't waive your fingers at our American friends, the OECD average for personal debt 79.5%. Essentially when you borrow money, can't make the repayments and the house is worth less than what you paid for it, you are in a bit of bother. Top that with some credit card debt, and you get the picture.

Retail Economics

The World is fuelled by American Consumerism - Over 60% of America's GDP is powered by consumer spending. No matter what the politicians promise to rectify over there, it's going to take some time for the world economy to turn around. I'll explain things as I go along.

Surely We Can't Rely on the US for Everything - When the US stop spending, poor old countries like China, India, and their Central/South American counterparts stop producing. No use making goods if no one is buying. China's growth is slowing and India has an issue with inflation (and some reported job losses). We need to hope and pray that they can be the growth engines of the world economy, whilst the original powers sought themselves out.

Yeah But What About These Countries With Commodities? Surely They've Got Money - When people stop spending money, factories stop producing items, which means they don't need the commodities to produce the products (or the fuel to ship them their). The markets know this, so they dump these commodity producing countries currencies. When their currency goes down, the price of imports (consumer products) goes up. The once cheap plasma screen TV, is not so cheap now.

The World Got Scared (Particularly Europe) - The number one selling car in the UK is BMW 3 Series (it alternates with the Ford Mondeo for the top spot), so you know they thought times were good. Also when a little known island called Iceland has businesses buying English Premier League soccer teams you know something is not quite right.

So when the US went under, Europe got cold feet, and all of the sudden the markets in Europe crashed. Banks, like all publicly listed companies, need shareholders money as capital for their business. When this capital gets pulled from under their feet, all of this debt that the banks had all along is being exposed. So the banks needed the governments money (new capital) to keep them running.

Why Bail Out the Banks - Because when people feel good they spend. When they feel scared they stop spending. For economies to grow they need people to spend money. It's a vicious cycle. So governments bailed the banks to make people feel safe and secure, so that they can spend their money again.

So what should you take from all of this. My advice - don't panic. You'll only do something stupid.

People are still buying things. It is estimated that 86% of purchases are emotional, so I don't think spending is going to go cold turkey. The people, who are tightening their spending, did not have the money to spend to begin with. It is just that when times were good, they got blinded and spent like crazy.

But here are some things you can do;

Increase prices on unique items, as this will protect you from inflation eating away at margins Focus on converting the people coming through the doors into customers. There is going to be less people shopping, you need to maximise the all opportunities Focus on building loyalty. It is proven that loyal customers spend more than people off the street, and come into your store(s) more times a year Tighten you product range to focus on core categories. Excess stock ties up cash, and a lack of cash closes down businesses.

True Cost Economics

What's the price of your lifestyle? Is your living room furnished in blood, or your wardrobe woven of pain and suffering? How about your body - are you fed with diminishment and despair? Every piece of merchandise we buy costs a set amount of work, energy and resources. What we pay for it in cash may - or may not - reflect what went into its making. If we buy cheaply, at a discount store where prices are kept artificially low, then the price is paid by others who have to suffer to make up for the portion of the price we refused to pay. If we allow others to negotiate for costs that leave too small of a margin for fair wages or adequate health concerns, then the price is paid by the destablization of the land and the people and the societies that produce it. But our bargain hunting gets us nowhere. In the end, we pay the full price, with interest - in wars brought about by people pushed too far, by terrorism and riots sparked by those who feel (often rightly) that their people and their land are being drained of life so that the rest of us can buy or drive cheap toys that we don't even appreciate, by environmental degradation that affects us all perpetrated by those simply too powerful to be stopped or too poor to care as long as they can eat and live. We must all face the inevitable fact that human suffering doesn't stop at the suffering human in question, but ripples out to all of us. No matter what the actual price tag says we pay in full measure for what we buy and use, either in cash or in kind. By choosing to buy less and choose more wisely, we allow ourselves the financial breathing space to afford the better, fairer-priced option, and we step away from supplying the negative cycles of economic hardship. Our actions heal rather than harm, support rather than undermine. And in the end, by working together we can give birth to positive, more equitable cycles where everybody benefits fairly and justly and where everyone gets a chance to demand as well as supply. Yes, this does mean that we can't load our carts, our houses and our bodies to overflowing every time we step outside our door. But by choosing quality over quantity, we create better health and a better world for those around us and for ourselves. And that's priceless.
